remove.bg 2024 Social Media Prize Draw: Terms
This Prize Draw is run by remove.bg, a Canva Austria GmbH brand (“Promoter”) of Ungargasse 37/BT1/3.3 1030 Vienna.The Prize Draw is free to enter, no purchase is necessary.
Eligibility: This remove.bg Social Media Prize Draw (“Prize Draw”) is open only to persons who are 18 years old or older as of the date of Entry. This Prize Draw is open to residents of Australia, Canada, New Zealand, United States and United Kingdom. Employees of Promoter, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (together, “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Prize Draw. This Prize Draw is not open to any individual in a jurisdiction where the Prize Draw or the individual entering the Prize Draw would be prohibited by law.
Agreement to Terms: By submitting an Entry to the Prize Draw, the entrant (“You”) agrees to be fully unconditionally bound by these terms. You also represent and warrant that You meet the eligibility requirements and that the Prize Draw and You entering the Prize Draw is not prohibited in Your jurisdiction. If there is any conflict between any promotional materials about this Prize Draw and these Terms, these Terms prevail. In addition, You agree to accept the decisions of Promoter as final and binding as it relates to the Prize Draw.
Prize Draw Period: Entries for the Prize Draw will be accepted online from August 12, 2024 at 10:00 (CET) until September 2, 2024 at 10:00 (CET); (“Prize Draw Period”). Entries must be received before the end of the Prize Draw Period.

How to Enter:
(a) To participate in the Prize Draw, you must submit an entry in accordance with the Prize Draw Guidelines (“Entry”).
(b) Only one Entry is allowed per person.
(c) Entries must comply with the brief listed in the Prize Draw Guidelines. Entries that contain offensive, defamatory or sexual content, violence or gore, or promote discrimination against any individual or group or that otherwise contain content that in the view of Promoter is inappropriate, will not be accepted.
(d) The Entry must fulfill all Prize Draw requirements, as specified in these Terms, to be eligible to win.
(e) Entries that are incomplete or do not adhere to the Terms may be disqualified at the sole discretion of Promoter.
(f) If You use fraudulent methods or otherwise attempt to circumvent these Terms, your submission may be removed from eligibility at the sole discretion of Promoter.

Prizes:
(a) Up to a maximum of 2 winners will be selected at random (“Winners”).
(b) Each Winner will receive:
(i) 1 (one) digital gift card worth USD$700 from the B&H Photo online store at https://www.bhphotovideo.com/ , which are subject to the B&H Photo Gift Card Terms and Conditions (https://www.bhphotovideo.com/find/HelpCenter/Payments.jsp#bhGiftCard) and will be sent to the Winners’ email addresses shortly after the announcement of the Winners.
(c) All specifics of the prizes shall be solely determined by Promoter. Prizes are as stated, they are not transferable, and there are no alternative prizes or cash substitutes. If for any reason there are logistical or other issues with providing a prize, Promoter may, at its sole discretion, provide a substitute prize of equivalent value.
(d) Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner, and you may wish to talk to your tax advisor about any personal tax consequences.

Winners Selection and Notification:
(a)The Prize Draw is a game of chance, skill has no part in determining the Winners.
(b) Winners are drawn at random.
(c) The Winners will be notified via email and announced on Promotor’s Facebook, Twitter and Instagram Feed and Facebook and Instagram Stories within fifteen (15) days following the selection of the winners.
(d) To the extent permitted by law, Promoter shall have no liability for:
(i) any Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information;
(ii) any Winner’s inability to receive or participate in any component of the prize.
(e) If a Winner cannot be contacted, is ineligible, fails to claim the prize within forty-eight (48) hours from the time notification was sent, or fails to timely return a completed and executed declaration and release, or provide any other information or documentation (including, but not limited to any relevant completed tax documentation if required), the prize may be forfeited and an alternate Winner selected at random. Receipt by Winner of the prize offered in this Prize Draw is conditioned upon compliance with any and all federal, state, and local laws and regulations.
(f) ANY VIOLATION OF THESE OFFICIAL TERMS BY WINNER, AT PROMOTER’S SOLE DISCRETION, WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE PRIZE DRAW AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You:
By submitting an Entry, You:
(a) understand and consent to Promoter, anyone acting on behalf of Promoter, and Promoter’s licensees, successors, and assigns, having the right, where permitted by law, to print, publish, broadcast, distribute, and use (including in an excerpted or slightly modified form, whilst keeping with the original sentiment) in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your Entry, likeness, name, social media handle and statements about the Prize Draw, for news, publicity, information, regulatory, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
(b) represent and warrant that your Entry is an original work of authorship by You, and does not violate any third party’s proprietary or intellectual property rights. If your Entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Promoter. If the content of your Entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Promoter from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Promoter may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
(c) agree to execute such further documents as may be reasonably required by Promoter to give effect to these rights.

Promoter Rights: Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Prize Draw in the event Promoter becomes aware or reasonably suspects there to be virus, bug, non-authorized human intervention, fraud, or other cause beyond Promoter’s control that could affect the administration, security, fairness, or proper conduct of the Prize Draw. In such a case, Promoter may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Promoter. Promoter reserves the right to disqualify any Entry or Winner that, in its absolute discretion, could bring Promoter into disrepute. Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Prize Draw or website or violates these Terms. Promoter has the right, in its sole discretion, to maintain the integrity of the Prize Draw, to reasonably void entries, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Prize Draw may be a violation of criminal and civil laws. Should such an attempt be made, Promoter reserves the right to seek damages to the fullest extent permitted by law. By participating in this Promotion, You acknowledge that:
a) this Prize Draw is in no way sponsored, endorsed or administered by, or associated with B&H Photo, Meta or X or any other social media site and you fully release and hold Meta, X or any other social media site harmless from liability in relation to this Prize Draw;
b) by accepting the Prize you are not, and will not, be violating any laws, rules, or regulations applicable to you, including any rules related to your employment; and;
c) in the event Promoter reasonably determines, in its sole discretion, that fulfilling your Prize would violate any law or regulation that is applicable to you, the Prize or Promoter, your Prize will be void and your entry disqualified.
Liability: By submitting an Entry, to the extent permitted by law, You agree to release and hold harmless Promoter and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether or not caused by negligence, from: (i) Your participation in the Prize Draw and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Prize Draw; (v) electronic or human error in the administration of the Prize Draw or the processing of entries. To the fullest extent permitted by law, Promoter is not liable where an entrant has breached local laws and/or regulations in connection with this Prize Draw. You may have certain non-excludable rights or remedies under law. These Terms are subject to any non-excludable right or remedy You have under law. These Terms are governed by, and construed in accordance with the laws of New South Wales, Australia and the courts of Sydney, New South Wales, Australia shall have exclusive jurisdiction over any proceedings in connection with this Prize Draw.
Privacy Policy: Promoter collects information from You (such as your name, social media profile, caption and details you provide in entering the Prize Draw, including: country of residence, full name, email address whether You are a photographer or work at a photography studio, the number of images processed by You or your company in a year, and other information provided that will be collected as part of the Prize Draw) in order to conduct the Prize Draw and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry to the Prize Draw is conditional on providing this information. For the avoidance of doubt, when you complete the entry form, you agree to be contacted by the remove.bg sales team, however, you will not be automatically added to our marketing list (there will be a tick box if you choose to opt in to receive this). This section should be read in conjunction with Promoter’s Privacy Policy, which explains how Promoter collects, stores, and uses personal information, and sets out your data protection rights, including access and correction and how you may complain or raise a query about our handling of your information.
